Substantial Amendment to the 2015-2019 Consolidated Plan and the 2016 Annual Action Plan Approved 11/22/16
The National Housing Trust Fund (NHTF), funded by an assessment on loans made by Fannie Mae and Freddie Mac and administered by HUD, was established under the Housing and Economic Recovery Act of 2008. On January 30, 2015, HUD published an interim rule (24 CFR Parts 91 and 93) providing guidelines for states to implement the NHTF. Each state’s allocation was published on May 4, 2016, and New Mexico received an allocation of $3 million. The NHTF funding is considered a substantial change to our Consolidated Plan and Action Plan and requires a Substantial Amendment. By August 16, 2016, MFA must submit an NHTF Allocation Plan to HUD as well as a Substantial Amendment to the 2015-2019 Consolidated Plan (Con Plan) and the 2016 Annual Action Plan (16 AAP). This Substantial Amendment also includes a change to the maximum amount of HOME funds per multifamily project to $1,000,000 per project for Community Housing Development Organizations (CHDOs)/$800,000 for non-CHDOs to incentivize those organizations to apply for HOME Multifamily Development funding.
In accordance with HUD requirements, MFA must publish the Substantial Amendment with the draft NHTF Allocation Plan for public comment over a 30-day period. MFA held a public hearing on June 20, 2016 at 10 am in the MFA Board Room. Only one member of the public attended and made comments. The comments and MFA’s responses are included in the attachment to the Substantial Amendment. The draft Allocation Plan which was approved by the Board on July 20th contains the broad guidelines under which MFA will distribute NHTF funds. The guidelines in the draft Allocation Plan are based on the NHTF regulations, HUD-issued guidance, the Con Plan and the 16 Annual Action Plan, and the structure of MFA’s existing housing development programs such as the LIHTC and HOME programs.
Staff submitted the approved Allocation Plan to HUD by August 16, 2016 and also submitted the Substantial Amendment contingent upon Board approval.
The revised Consolidated Plan and 2016 Action Plan screens are attached. The majority of the changes concern inclusion of the Housing Trust Fund into MFA’s HUD programs. An additional change seeks to incentivize CHDOs to apply for HOME Multifamily Development funding by increasing the maximum amount of HOME funds to $1,000,000 per project for CHDOs/$800,000 for non-CHDOs.
2015- 2019 Consolidated Plan Approved 5/13/15
MFA and DFA have developed a five-year plan for housing, community development and infrastructure. The plan guides housing, community development and infrastructure investment policy and actions such as housing, economic development, public facility, water and infrastructure investment over the next several years. Known as the “Consolidated Plan for Housing and Community Development,” the study is required every five years by the U.S. Department of Housing and Urban Development (HUD). The planning process just concluded is intended to comprehensively fulfill three basic goals: to provide decent housing, to expand economic opportunities and to provide a suitable living environment. Creating a successful plan hinged on input from people who are knowledgeable about housing and community development in New Mexico – people like you.
MFA and DFA hosted two public hearings on May 20 at the MFA office, 344 Fourth Street SW in Albuquerque, at 2:00 pm and at 5:30 pm. The purpose of the meeting was to obtain input on housing and community development needs in New Mexico, especially low and moderate income and special needs persons. The information gathered was used to develop the 2015 – 2020 Consolidated Plan, the 2015 Annual Action Plan and the 2015 Analysis of Impediments to Fair Housing Choice. These documents guide policies and set priorities for spending federal funds from the Department of Housing and Urban Development for Community Development Block Grant (CDBG) funds, HOME Investment Partnership Programs (HOME) funds, Emergency Solutions Grant (ESG) funds and Housing Opportunities for Persons with AIDS (HOPWA) funds. Areas to be funded are, generally, all of New Mexico outside the cities of Albuquerque, Santa Fe, Farmington, Rio Rancho, and Las Cruces.
